Can I Still Take Traffic School If My Case Is Not Dismissed?


Contesting a ticket through trial by written declaration and traffic school allowance are independent. Fighting your ticket does not make a driver ineligible for traffic school.  Remember, traffic school is only necessary IF your case is not dismissed by the courts.  This only happens about 20% of the time when you use trafficticketbust.com.

What is the “Pay My Ticket” Guarantee?

For CVC 22350(Basic Speed Law) infractions under 10 mph over the speed limit, we will pay your ticket for you if you do not receive a case dismissal.  Eligible to premium service clients.  (Up to $150.00)

How long does the whole process take?


After requesting for the trail by written declaration, the court will send you the appropriate form (TR-205) about three weeks after they receive it.  Once you send in the TR-205, it takes about 60-90 days to hear back from the courthouse.

Do I have to personally go to the office of trafficticketbust.com to engage in the services?

No.  Everything can be done through e-mail, fax, phone, or traditional mail.  This makes the process very easy and convenient for our clients.

What is required of me after submitting my information online?

*If you chose the eService, you will download the file and follow the instructions.

*If you chose the Premium service, we will contact you and send you a blank “Request for a Trial by Written Declaration”.  Fill it out and send it to the courts with your bail amount.  In the meantime, send us a copy of your ticket.  Once you receive the TR-205 form in the mail, you are then responsible for filling out the TR-205 and attaching the statement that we provide you with. You are responsible for sending it CERTIFIED mail no less than 5 business days before your trial deadline.

What is a Trial by Written Declaration (TR-205)?

Vehicle Code Section 40902 allows the defendant (you the cited driver) to contest citations in writing, without having to make a personal appearance in court. A Trial by Written Declaration is available in cases involving infractions of the Vehicle Code or of local ordinances of the Vehicle Code. Violations eligible for a Trial by Written Declaration must be infractions only. Misdemeanors and cases involving accidents are ineligible for a Trial by Written Declaration.

What does the court require of me to process a Trial by written Declaration?

You must post bail before the trial can be issued.  However, once the case is dismissed, you will receive the bail amount back.

What is the Bail amount?

The bail amount is the amount of the fine associated with your ticket.  It does not include the court traffic school fee.  The bail amount can be found the CA court’s schedule of fees.  It is also found on your courtesy notice.  If you do not know the bail amount or if you have not received your courtesy notice from the court, call the court to get the bail amount for your citation.

Who do I make the bail check payable to?

Your bail check needs to be made out to the “Clerk of the Court”, unless otherwise directed by the courthouse.

Why do I need to send all of my documents to the court via Certified Mail?

Just in case the court never receives your documents, you will want to have proof that you sent them before the deadline.  Make sure to keep your certified receipt for this reason.

What is a courtesy notice?

This is the first contact made from the courts.  It states the infraction, the bail amount, appearance date, case number, court address, offense date, and verifies your information.  The notice also provides instructions on traffic school, pleading guilty, pleading not guilty, and consequences of not responding to your infraction.

What if I’m found guilty or unsatisfied with the court’s decision?

You can request a Trail De Novo, or “New Trail”  You must submit a written request (Form TR-220) to the court no more than 20 calendar days after the court releases their decision.  We will also refund you our Premium Service charge.

What is a Trial De Novo (TR-220)?

Trial De Novo is an opportunity for another trial.  You will be given a time to appear in court and present your case.

Does trafficticketbust.com represent me in court for a Trial De Novo?

No.  We can give you tips for your court case, but we recommend consulting an attorney for further advice.  Coming soon, we will offer a “Trial De Novo Package” for a small fee.

If I’m found guilty in court will I still qualify for traffic school?

There are some restrictions to eligibility of traffic school, mainly that it cannot be taken more than once every 18 months.  We request traffic school for all of our clients who are eligible, unless otherwise requested not to.

How do I get a trafficticketbust.com refund if if my case is not dismissed?

Simply fax us a copy of your “Notice of Decision” paperwork from the court.  Your refund will be processed and sent out within 5 business days.
